A spousal lifetime access trust, or SLAT, begins with a trade: one spouse gives property to an irrevocable trust, while the other spouse may remain eligible for distributions. The donor removes direct ownership and the household retains only indirect, conditional access through the beneficiary spouse.

Wyoming does not define a separate statutory entity called a SLAT. Wyoming trust law supplies the formation, spendthrift, fiduciary, administration, and directed-role framework; federal law governs the intended gift, estate, and income-tax consequences. The plan works only when those systems and the family’s actual finances agree.

Test whether the donor can live without the property

Before selecting trustees or drafting distributions, model the household without trust access. The beneficiary spouse may die first, a divorce may end eligibility, the trustee may deny a request, trust property may decline, or the instrument may reserve assets for descendants.

Prepare separate balance sheets for each spouse. Identify ownership, basis, value, debt, guarantees, projected expenses, insurance, retirement assets, emergency reserves, and pending claims. The donor should transfer only property the donor can genuinely relinquish.

If the plan assumes regular trust payments will fund the donor’s ordinary obligations, the economic arrangement may contradict the completed-gift and estate-exclusion objectives. An undisclosed promise between spouses or with the trustee is not a substitute for an enforceable distribution provision.

Establish a valid Wyoming trust foundation

Wyoming §§ 4-10-401 through 4-10-405 govern creation. The settlor needs capacity and intent, the trust needs a definite beneficiary or authorized purpose, the trustee must have duties, and one person cannot be both sole trustee and sole beneficiary.

A conventional SLAT is third-party settled as to the beneficiary spouse because the donor spouse supplies the property. Wyoming §§ 4-10-501 through 4-10-505 can support spendthrift and discretionary protection for that beneficiary. This is different from a self-settled qualified spendthrift trust under § 4-10-510.

That distinction depends on substance. If the beneficiary actually supplies property attributed to the donor or the donor receives benefits beyond the document, creditor and federal tax analysis can change. Trace every contribution to its owner and keep the spouses’ transactions separate.

For a family outside Wyoming, map why Wyoming law or administration is being used. Sections 4-10-107 and 4-10-108 address governing law and principal administration, but the marital domicile, property situs, beneficiary residence, and source income remain relevant.

Make the gift complete in documents and conduct

The transfer should change legal ownership through the correct instrument: an account registration, assignment, entity consent, or deed. Preserve valuation and proof of delivery. A schedule attached to the trust does not replace the transfer required for the asset.

Federal gift tax applies to transfers for less than full and adequate consideration, subject to exclusions, deductions, and available exemption. A SLAT contribution intended as a completed gift may require Form 709 even when no current tax is payable. The return supports valuation disclosure, use of the basic exclusion, any GST allocation, and the limitations record.

Retained use or enjoyment can bring property into the donor’s gross estate under 26 U.S.C. § 2036. Administration therefore matters as much as drafting. Repeated payments that discharge the donor’s obligations, an understanding that distributions will be returned, or donor control of the trustee can conflict with the intended separation.

Design access as beneficiary-centered discretion

The instrument may authorize distributions for health, education, maintenance, support, housing, emergencies, or another stated purpose. It may use an independent trustee’s sole discretion. It also may permit distributions to descendants at the same time.

For each request, the trustee should identify:

  • the beneficiary and purpose of the request;
  • the governing clause and distribution standard;
  • relevant resources, circumstances, liquidity, and tax effects;
  • any conflict or directed distribution authority;
  • the decision, amount, timing, and payment method; and
  • what evidence and beneficiary communication belong in the file.

Direct payment to a provider may produce a clearer record than payment into a joint account. A loan requires genuine terms, repayment capacity, documentation, interest, and enforcement. Calling an undocumented distribution a loan does not change its substance.

Wyoming’s directed-trust provisions can place investment authority with a family or professional adviser while reserving sensitive distributions to an independent fiduciary. The instrument must still provide information flow and a successor for each office.

Analyze two-spouse plans under the reciprocal-trust doctrine

Some couples consider a trust created by each spouse. United States v. Estate of Grace, 395 U.S. 316 (1969), supports uncrossing reciprocal arrangements when they are interrelated and leave the settlors in approximately the same economic position as if each created a trust for that settlor’s own benefit.

Different signing dates or assets are not automatic protection. Compare the entire arrangement: purpose, beneficiaries, values, timing, trustees, distribution language, powers of appointment, removal rights, and economic effect. Material differences need substance and should not be manufactured solely on paper.

Each donor must also own the contributed property. A last-minute gift from one spouse to the other followed by coordinated trust funding raises ownership, step-transaction, and transfer-tax questions. Two trusts require independent analysis and a documented reason for their separate terms.

Do not assume the marital deduction

A spouse as beneficiary does not by itself produce a federal gift-tax marital deduction. Section 2523 generally permits a deduction for transfers to a spouse but restricts many terminable interests unless a statutory exception applies. A conventional SLAT often uses the donor’s basic exclusion instead of relying on the marital deduction, while specially designed QTIP arrangements follow different rules.

Citizenship also matters. Section 2523(i) generally denies the marital deduction for a noncitizen spouse, subject to specific provisions. Confirm citizenship, tax residence, and marital status before the plan is designed.

Draft for the events most likely to break access

Beneficiary spouse dies. Household access through that spouse ends. Define continuing descendant trusts, powers of appointment, fiduciary succession, and life-insurance coordination.

Divorce occurs. Decide whether “spouse” means the named person, the person married to the donor at a given time, or a beneficiary whose interest ends. Coordinate the trust with marital agreements and the law of the marital domicile.

Either spouse loses capacity. State who can request information, exercise appointment or removal powers, and act for an incapacitated fiduciary or beneficiary. Coordinate powers of attorney and privacy releases.

The family moves. A new domicile may change income tax, marital-property rights, creditor law, and court jurisdiction even when Wyoming continues as governing law.

Trust assets lose value. The donor needs liquidity independent of the trust. A fiduciary can properly decline a distribution, and a concentrated asset can fall.

Coordinate income tax and reimbursement

A SLAT may be a grantor trust whose income is reported by the donor, or it may have different federal classification depending on its terms. Identify who pays tax, what statements or returns are required, and whether the trustee may reimburse tax.

Wyoming’s 2025 amendments added and refined trustee tax-reimbursement powers in § 4-10-816. A state-law power does not settle the federal estate-inclusion result. The actor’s eligibility, discretionary process, attributed tax calculation, beneficiary effects, and instrument language need review.

Wyoming has no individual state income tax, but another state may tax the donor, beneficiary, trust, or source income. Repeat the nexus analysis after a move and before a large sale or distribution.

Maintain the SLAT as an independent trust

Keep separate accounts, funding evidence, appraisals, Form 709 and GST records, trustee decisions, beneficiary requests, tax reporting, and all directions. Avoid casual household transfers that make tracing impossible. Review the arrangement after death, divorce risk, incapacity, a new child, a major transaction, fiduciary change, or tax-law development.

The decisive Wyoming SLAT question is not how much practical control the donor can quietly retain. It is whether the family can accept a real gift, rely on a properly governed trustee process, and remain financially secure if indirect spousal access ends tomorrow.
